Plaintiff environmental group accuses bauxite refinery operator of violating Clean Water Act

The Louisiana Environmental Action Network, Inc. (LEAN) has filed a significant environmental lawsuit against Atalco Gramercy, LLC, alleging severe violations of environmental laws that could have far-reaching impacts on the community and ecosystem. The complaint was lodged in the United States District Court for the Eastern District of Louisiana on October 31, 2025. LEAN accuses Atalco Gramercy of multiple breaches of the Clean Water Act and the Solid Waste Disposal Act due to improper waste management practices at their bauxite ore refinery.

LEAN, a Baton Rouge-based organization dedicated to protecting Louisiana’s natural environment, asserts that Atalco Gramercy’s operations have consistently violated state and federal environmental regulations. The complaint details numerous infractions observed during inspections by the Louisiana Department of Environmental Quality (LDEQ) between September 2024 and June 2025. These include unauthorized disposal of solid waste into state waters, failure to maintain adequate barriers and inspection records, and discharge of hazardous materials into local waterways like the Mississippi River and Blind River Swamp.

The plaintiff claims that these actions not only contravene specific permit conditions but also pose significant risks to public health and local ecosystems. LEAN highlights how these violations directly harm its members who live near affected waterways and rely on them for recreation and aesthetic enjoyment. “Water pollution from Atalco’s facility threatens both our environment and our communities,” said a representative from LEAN.

In response to these alleged violations, LEAN is seeking declaratory relief to confirm Atalco’s legal breaches, civil penalties commensurate with each day of violation, injunctive relief mandating compliance with environmental standards through improved waste management practices, as well as compensation for attorney fees and other related costs.
