Marlon Jackson, a Louisiana resident with paraplegia, has filed a lawsuit against the owners and operators of a donut shop for failing to comply with accessibility laws. On November 13, 2025, Jackson filed his complaint in the United States District Court for the Middle District of Louisiana against Song Bok Choe and Erico F Macaraeg MLD LLC. The suit alleges violations of the Americans with Disabilities Act (ADA) and the Louisiana Commission on Human Rights (LCHR), seeking damages and injunctive relief.

According to the complaint, Marlon Jackson is a qualified individual with a disability under both federal and state law due to his T-11 spinal cord injury that necessitates the use of a wheelchair. He claims that during his visit to Mary Lee Donuts located at 14501 Plank Road in Baker, Louisiana, he encountered several architectural barriers that hindered his ability to access the property fully. “The ramps that connect the parking lot to the promenade are inaccessible,” Jackson’s complaint states, highlighting issues such as impermissible slopes and gaps within designated accessible parking spaces.

Jackson argues that these barriers violate Title III of the ADA, which mandates public accommodations be accessible to individuals with disabilities. He also asserts that these conditions breach LCHR statutes by denying him full enjoyment of goods and services offered at the property. The lawsuit details specific obstacles including non-compliant parking spaces lacking proper access aisles and routes from parking areas containing impermissible changes in level.

The plaintiff seeks not only compensatory damages but also requests that the court order defendants to make necessary alterations to ensure compliance with accessibility standards. Jackson emphasizes that removing these barriers is “readily achievable” without imposing an undue burden on defendants. Additionally, he seeks coverage for attorneys’ fees and costs associated with bringing this action forward.
