Local resident sues Super ES Market LLC for alleged disability access violations

Allegations of architectural barriers at a local grocery store have led to a lawsuit seeking changes to ensure accessibility for individuals with disabilities. The complaint was filed by Christopher Lucineo in the United States District Court for the Eastern District of Louisiana on April 14, 2026, naming Super ES Market LLC as the defendant.

According to the court filing, Christopher Lucineo is a resident of Jefferson Parish who uses a wheelchair due to paraplegia resulting from a spinal cord injury. The lawsuit states that Lucineo lives less than one mile from Quicks Food Mart, located at 6301 Acre Rd, Marrero, LA 70072, which is operated by Super ES Market LLC. The plaintiff alleges that during his most recent visit to the property in March 2026, he encountered several architectural barriers that limited his ability to access goods and services offered at the grocery store.

The complaint outlines specific issues observed by Lucineo during his visit. These include: “The designated-accessible parking space lacks a properly sized access aisle,” “the ramp that serves the designated-accessible parking space is too steep and lacks edge protection,” “the accessible route that connects the designated-accessible parking space to the Property’s entrance contains impermissible gaps and changes in level,” and “the Property’s sales and service counter is located too high off the finished floor.” Lucineo asserts that these conditions violate Title III of the Americans with Disabilities Act (ADA) as well as provisions of the Louisiana Commission on Human Rights (LCHR).

The filing claims that these barriers exclude Lucineo from programs, services, and activities available at the property and deny him “the equal opportunity to participate in, or benefit from” those offerings. It further alleges that removal of these barriers is “readily achievable” and would not place an undue burden on Super ES Market LLC. According to Lucineo’s legal team, failure to address these issues constitutes discrimination under both federal and state law.

In addition to outlining alleged violations of ADA regulations (42 U.S.C. § 12181 et seq.) and LCHR statutes (LA. REV. STAT. ANN. § 51:2231 et seq.), the complaint requests several forms of relief from the court. These include a declaration that Super ES Market LLC is in violation of applicable laws; an order directing alterations to make the property accessible; compensatory damages for injuries suffered; reasonable attorneys’ fees and costs; and any other relief deemed appropriate by the court.

Lucineo also states he has retained legal counsel specifically for this action and seeks reimbursement for associated legal expenses under both federal and state statutes governing disability rights cases.
