Guatemalan national indicted for illegal re-entry after previous deportation

Emner Isaias Najera-Najera, a 41-year-old native of Guatemala, was indicted on March 19 for illegal re-entry of a removed alien, according to an announcement by U.S. Attorney David I. Courcelle on Mar. 25.

The indictment alleges that Najera-Najera was found in the United States on March 12 without authorization from the Attorney General after having been previously deported on June 22, 2017.

If convicted, Najera-Najera faces up to two years in prison, a fine of up to $250,000, up to one year of supervised release, and a mandatory special assessment fee of $100 for the charge related to re-entry after removal.

Courcelle said: “An indictment is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.”

This case is part of Operation Take Back America, which is described as a nationwide initiative using Department of Justice resources to address illegal immigration and target cartels and transnational criminal organizations. The operation also involves efforts from the Organized Crime Drug Enforcement Task Forces and Project Safe Neighborhood.

Courcelle praised the work done by U.S. Border Patrol in investigating this matter. Assistant United States Attorney Carter K.D. Guice Jr., from the General Crimes Unit, is handling prosecution.
