A Louisiana resident is seeking legal action to address alleged barriers faced by individuals with disabilities at a local restaurant, citing violations of both federal and state accessibility laws. The complaint was filed by Michael Lucas in the United States District Court for the Eastern District of Louisiana on March 16, 2026, naming Planet Wingz “A Taste of Heaven” L.L.C. as the defendant.
According to court documents, Michael Lucas claims that Planet Wingz “A Taste of Heaven” L.L.C., which operates a restaurant at 545 South Columbia Street in Bogalusa, Louisiana, failed to comply with requirements set forth by the Americans with Disabilities Act (ADA) and the Louisiana Commission on Human Rights (LCHR). Lucas alleges that these failures have resulted in discrimination against him as an individual with paraplegia who uses a wheelchair for mobility.
The complaint outlines that Lucas is a citizen residing in Washington Parish, Louisiana, and identifies himself as a qualified individual with a disability under both federal and state law. He reports that he lives less than two miles from the property in question and has visited the restaurant previously, most recently in February 2026. During his visit, Lucas states he encountered architectural barriers that prevented him from accessing programs, services, or activities offered at the property on an equal basis with other members of the public.
Specifically, Lucas alleges that there are no designated-accessible parking spaces at the property and references additional mobility-related ADA barriers to be identified after a complete inspection. The complaint asserts: “Upon information and belief, all barriers to access and ADA violations still exist and have not been remedied or altered in such a way as to effectuate compliance with the provisions of the ADA, even though removal is readily achievable.” Lucas further contends that removing these barriers would be feasible for Planet Wingz “A Taste of Heaven” L.L.C. without imposing an undue burden.
Lucas claims these conditions amount to discrimination under Title III of the ADA (42 U.S.C. §12181 et seq.) as well as under LA. REV. STAT. ANN. § 51:2231 et seq., which governs human rights protections in Louisiana. The complaint cites state law prohibiting denial of full and equal enjoyment of goods or services based on disability status: “it is a discriminatory practice for a person to deny an individual the full and equal enjoyment of goods, services, facilities, privileges, advantages, and accommodations of a place of public accommodation…on the grounds of…disability.” According to Lucas’s filing, he believes himself injured by this conduct due to exclusion from opportunities available to others at the establishment.
The lawsuit seeks several forms of relief from the court. Lucas requests declaratory judgment stating that Planet Wingz “A Taste of Heaven” L.L.C.’s property is not compliant with applicable laws; injunctive relief ordering alterations necessary for accessibility; compensatory damages pursuant to state law; reasonable attorneys’ fees; costs including expert fees; and any other relief deemed appropriate by the court.
